Dubai: A groundbreaking verdict has been handed down by the Dubai Court, awarding a compensation of 11.5 crores, i.e., 5 million dirhams, to a young Malayali, Shifin, who suffered severe injuries in a tragic car accident. This marks the second case in the UAE where a car accident victim received such a significant compensation amount.

The said motor vehicle accident happened on March 26, 2022. Shifin arrived in the UAE as a helping hand to his expatriate father to support his family of five members and started to work at a supermarket. The 22-year-old boy, who had left the supermarket on a motorcycle with goods, was hit by a car driven by a native. The driver fled the scene, but the police quickly apprehended him with the help of CCTV footage. Shifin was seriously and badly injured. He was taken to Al Ain hospital and received expert treatment, but his head was badly injured.

After two weeks of treatment, he was transferred to a private hospital for better care and treatment. Despite the intensive medical attention, doctors determined that Shifin had lost the functionality of about ten organs due to the brain injury, and he was placed in a ventilator. He was moved to a hospital in Abu Dhabi. With continuous and best possible medical treatment in the UAE for a period of 18 months, Shifin showed slight improvement and began to move his head. With this recovery, it was decided to take him to India for further treatment.

The case was led by Fran Gulf Advocates. Initially, the Insurance Authority Court awarded 2.8 million dirhams as compensation, considering Shifin’s physical and mental state. However, the legal team, understanding the extent of his injuries and future medical needs, argued for higher compensation, and their dedicated efforts led to an increased award of 5 million Dirhams by the Appellate Court, later upheld by the Supreme Court. Meanwhile, parallel dedicated support from Al Ain KMCC volunteers played a crucial role in navigating the complex legal proceedings across various courts to achieve this outcome.
